Planning certificates

In New South Wales legislation, a planning certificate or Section 10.7 Certificate provides information about a specific parcel of land. It outlines the development potential and any restrictions, controls, or conditions that apply. This information is crucial for property owners, buyers and developers as it helps them understand the land's current zoning, planning controls, and potential development constraints. 

They are named Section 10.7(2) planning certificates because they are issued by councils pursuant to Section 10.7(2) of the Environmental Planning & Assessment Act 1979.

Why would I need a planning certificate?

There are two types of Section 10.7 planning certificates. The type of information contained in each type of certificate is explained below

Section 10.7(2) planning certificates

These are the most commonly sought after certificate, especially by conveyancing professionals. Section 10.7(2) planning certificates are required to be attached to a sale contract when property is being sold to inform buyers of relevant planning matters.

The main types of information contained in a Section 10.7(2) planning certificate are

  • Names of relevant state, regional and local planning policies that apply to the land

  • Zoning of the land including a description of permissible and prohibited land-use activities

  • Identification of any development standards affecting the erection of a dwelling-house

  • Whether the land contains critical habitat, conservation areas or items of environmental heritage

  • Whether complying development is able to be carried out on the land

  • Whether the land is located within a mine subsidence district

  • Whether the land is subject to road widening or reserved for acquisition

  • Whether the land is subject to any hazard risk restrictions

  • Whether the land is flood liable and/or bushfire prone

  • Whether the land is subject to a property vegetation plan or biobanking agreement

  • Whether the land is contaminated

Section 10.7(5) planning certificates

These are an additional certificate that identify the following information

  • Whether any buildings or structures have been approved on the land in previous two years

  • Whether or not local planning rules would allow council to consider a development application for the erection of a dwelling-house on the land

 

How can I apply for a planning certificate?

There are a number of ways that you can apply for a 10.7 planning certificate, including

  • In person at council's Administration Building, 141 East Street Narrandera
  • Download and complete an application form and return it to council with the prescribed fee
  • Ask your conveyancing solicitor to lodge the application on your behalf
